COURT DECLARES HORSE SLAUGHTER TO BE ILLEGAL

Washington, D.C. (March 28, 2007) - In a 51-page opinion issued just hours ago, United States District Court Judge Colleen Kollar-Kotelly held that the slaughter of horses in America violates federal law.  In her opinion, issued in response to a lawsuit filed in February 2006 by the Society for Animal Protective Legislation (SAPL) and other humane organizations and individuals, Judge Kollar-Kotelly ruled that the U.S. Department of Agriculture (USDA) violated the National Environmental Policy Act by failing to conduct an environmental impact review of its decision to allow the continuation of horse slaughter.

“Tonight, after years of legislation and litigation, America’s three horse slaughterhouses can no longer kill horses for human consumption,” states Chris Heyde, deputy legislative director for the Society for Animal Protective Legislation.  “We call on Illinois-based Cavel International to work with the humane and rescue communities to find permanent safe homes for the hundreds of horses who were slated for slaughter, to give them a second chance at life.”

The rule that was vacated by the court, was promulgated by the USDA’s Food Safety and Inspection Service to create a fee-for-service inspection process for horses slaughtered for human consumption.  The rule circumvented a Congressionally approved amendment to the FY 2006 Agricultural Appropriations Act that cut federal funding for the required inspections.  Because of continuing resolutions approved by Congress to fund the government, today's ruling is effective immediately.

There are three horse slaughterhouses in America, one in Illinois and two in Texas.  Though the Texas plants were recently forced to stop slaughtering horses for human consumption when an appellate court upheld a Texas law making it illegal to sell, possess and transport horsemeat for sale for human consumption, the Illinois plant has been killing approximately 1,000 horses per week.

“The American public has overwhelmingly opposed the slaughter of America’s horses for human consumption and now the courts have declared horse slaughter to be illegal,” adds Heyde.  “While horses will no longer be butchered in the U.S. they can be hauled under appalling conditions to a similarly brutal death in plants across the U.S. border.  Congress must pass federal legislation to extend the protections to all horses and to send a clear message to those few who profit from this barbaric trade."

Currently pending in Congress are H.R. 503 and its Senate companion measure, S. 311, which would ban the slaughter of horses for human consumption and prohibit the transport of horses outside of the United States for slaughter.

Now that slaughter is illegal, horses will be transported to Mexico where they do not know the meaning of "Humane."  Slaughter there is often carried out with the horse FULLY AWAKE AND ALIVE.

 

That's just the beginning.

 

Mexican coyotes are now sending buyers into the United States to pick up American horse for transport into Mexico.  THAT'S STILL NOT ALL OF IT!

 

These human smugglers don't care about the horses. They only want the EMPTY TRUCKS. They then build secret compartments to smuggle the illegal aliens. It is also a way to get drugs into the country.

 

This is a WIN/WIN situation for Mexican coyotes.

This is an EXTREMELY ignorant comment! Due to all the outcry from all the animal huggers that don't have a clue, these laws are getting passed so horses can't be sent to slaughter. Where are you going to find "permanent safe homes" for all these horses now that should have went to slaughter? There are not enough people out there to take them all.

For your information, there are a LOT of horses out there that NEED to go to slaughter! Usually there is a reason you see horses go through a sale barn (where most of the slaughter horses come from). Some are dangerous. Some have a screw loose and are dangerous to handle or ride. Putting them back out with the general population of people could get a person, INCLUDING A CHILD, severely injured or even killed! I've seen it time and time again, parents with their kid in the sale barn looking for a horse for their kid. This is the absolute worst place to buy your kid a horse! Also, many of the horses that go through are lame and/or permanently injured and will never be of any use to anyone, some living their life in pain. These horses need to go to slaughter to put them out of their misery. A lot of them are incurable or it would take a fortune to try to "fix" them. Some are so starved they're on their last leg. Is that a humane way to live?

Who can afford to take all these unwanted/dangerous/unsound horses? People breed backyard horses that aren't worth a dime just because they "want a baby" having no clue what it means to raise and train that baby. They can't sell it because it's junk. Heck, you can't sell a good horse right now. The horse market is down along with everything else. What are people supposed to do with them? Starve them because they can't afford to feed them? Get hurt or get their kid hurt because they didn't have enough knowledge to train it and now that cute little baby has grown to be a 1200 lb "pet" that thinks it's the alpha member of their horse/human herd?

The general population is very ignorant when it comes to horses. They see this magnificent and beautiful creature and that's all. They can't see the dangerous or permanently injured horses for what they are, in their mind this type of horse doesn't exist or they think there are enough bleeding hearts out there with endless amounts of money to care for them all.

This is a very hot topic with me. I love horses, I feed mine well, vet them well, they are all well mannered, trained and taken care of. If I get hold of one, and I have got hold of several in my time, that turn out to be dangerous, they go to the local auction hopefully for kill before they get someone hurt. I've learned over the years that it takes as much money to feed a good horse as it does a bad horse and only deal in quality horses now.

Just to clarify, not all auctions are bad. It's the local, usually weekly sales where you see the most of these

There are better sales that cater to better quality horses. You still have to be very careful about what you buy, but you won't see much junk/kill horses at these sales.

Sundowner, you are the one without a clue, get one. Don't be so lazy, get the facts, let me offer you some help since it seems like it's too much trouble for you to do the research. This site has a comprehensive list of links and resources for anyone who seriously wants the facts and not just spout off their own opinions which I for one could care less about. No one should care about my opinion that I make up out of the blue either. The facts are all that matter.
Furthermore, I don't see how hugging an animal is an insult as I'm sure you intended it to be. Thanks, I hug animals all the time, I think they're great. Pathetic people will say comments like this to try to make themselves look important, you are not. Get over yourself.

Sundowner (among others) needs to do much more research...learn about the % of horses that are STOLEN to be taken to slaughter, learn that, despite propaganda to the contrary, the majority of these horses are NOT old, infirmed, unwanted...many are healthy young horses, many are mares in foal, and MANY are simply bought out from under legit buyers who cannot compete with the bulging wallets of the killer buyers...and let's also consider the medications that horses take - specifically "not for animals designated for human consumption." And if these horses are considered "unwanted" then explain how the truckloads who were turned away from Cavel yesterday had rescues and humane organizations ON THE SPOT with $$$ to purchase these horses -curses to the truckers who would not accept the money and surrender the horses! The Humane Society US website also has much helpful information that paints a far different picture than the pro-slaughter forces would have us believe!

azRazz, a lot, if not most all, of those wild horses that are rounded up go up for adoption (the BLM has a website and advertises these adoptions/auctions). However, most of the ones that are adopted out are the babies and young horses, a lot, if not most, of the grown horses do not get adopted as no one wants them (I wouldn't either for various reasons). Then we, the taxpayers, feed and care for these horses as there is nothing else to do with them. They can not be sent for slaughter and they are not turned loose again. They are simply kept in pens/corrals and fed.

The horse is a part of our history, our present, & our future. They do NOT deserve to be sent to slaughter, to face the horrors there, & to die in fear.

I knew my comments would start a storm of people against me. I tried to look up your links but didn't get very far, the horse slaughter pamplet would not display. I was just curious to see what it said but I'm pretty sure I already know. Most of that kind of stuff is put out by animal rights extremists (I'll try to refrain from calling you/them animal huggers).

You all can slam me if you want. I've spent almost my entire 50+ years with horses and other livestock/animals. I love them very much. Horses are gorgeous creatures. Like you, I hug them sometimes, as well, and talk to them. I love on the babies and will drop everything I'm doing to watch them play (adults and babies). So do not make me out to be an unfeeling animal hater as I am not. I do, however, use commen sense. I've lived it, I've seen it, I know what goes on out there. Horse slaughter serves a much needed purpose. I do not need to repeat myself as I stand by what I said above.

Sadly, the pro-slaughter side would have you believe that horses going to slaughter are unwanted. Not true. Of the 108,000 horses slaughtered in 2006 over half fell into the category of stolen, sold to kill buyers under false pretense, PMU mares and their foals, wild mustangs whose protected status was removed with a stealth rider and the products of over-breeding and back-yard breeding. Not the old and infirm as pro-slaughter would have you believe. Most of the horses are young and healthy who have been cast aside. I have adopted a slaughter bound horse and so glad I did. There are more like me who would love to adopt a horse or two and provide them a forever home.
Reduce the breeding and you eliminate a big part of the problem.
I challenge anyone to view a slaughter video and still claim this is humane euthanasia.
To send an animal who has been trained to trust us to slaughter is a moral betrayal.

CTNan, yes there are rescue organizations out there that sometimes show up with $$$ to try to buy the horses that are going to kill. However, be that as it may, there are still not nearly enough people to pay for ALL the horses that go to kill. Also, I've been exposed to some of these rescue operations. Many times the horses are, as I said, injured or permanently disables. I've seen these people try to get donations to "fix" extremely expensive problems, or try to adopt them out to people who will care for them. These horses should have been left to slaughter like they were intended to go rather than now have to live their lives out in pain. Yes, sometimes there are good horses that go to kill. Also, sometimes horses are stolen with the intent of taking them to kill. The percentages are not high enough to justify shutting down the slaughter houses. They do more good than harm. Let's prosecute the criminals who steal the horses rather than shut down the facilities that unknowingly take them in. And you can quickly send information to the slaughterhouses (there are only three and I'm sure they have inspectors there as do all other slaughter houses) so they can hopefully catch the stolen horse before it's killed. Easier if it has a freeze brand. As for people bidding against the killer buyers, the kill horses have a market value the same as cattle. The killer buyers are not going to bid over the market value for a horse. If someone doesn't have enough money to outbid them then they probably aren't going to have enough money to pay for the upkeep on the horse to

Buying a horse is the cheapest part of horse ownership. Like I stated above, a lot of these horses are not fit for the family anyway, and that is who is usually trying to bid against the killers.

Another thing, I know there is a lot of bad publicity on horse transportation to the slaughter houses. There have already been laws passed for humane transport. Another thing that the animal rights extremists try to get people to buy into is that the horses are horribly mistreated while on the trucks.

I'm here to try to educate people. If the links don't work, I will try to answer your questions. There are a LOT of untruths out there.

Some of the horses that "need" to go to slaughter could actually have a HUMANE death by euthanasia. To see what really happens at slaughter, and here is another link--sorry, it's the only way I can get you there, the HSUS has videos available on their website. It is NOT humane.

Many of the horses that are slaughtered are young, babies, healthy, and could be wonderful pets if given a chance.

The PMU industry (Wyeth Labs, Premarin) dumps thousand of horses into the slaughter pipeline. THIS NEEDS TO STOP.

There are also a number (thousands) of horses that are stolen. ID chips are removed and thrown out in the garbage along with the carcass.

MOST Americans would like to see slaughter end. I'm comfortable representing the MAJORITY of Americans
